Quokka Sagl (the company) is a vacation rental management company that offers online reservations for vacation properties on behalf of third parties under the name Quokka 360.
Each contract is entered into between the person making the booking (the Tenant) and the company representing the owner (the Landlord).
The contract comes into force upon confirmation of the booking by the company and remains in force until the end of the booking, at the time of the Tenant's check-out.
OBLIGATIONS OF THE TENANT:
The property must be used exclusively for tourist purposes.
At the time of ONLINE CHECK-IN, the Tenant must fill in the information requested for each person who will be staying or otherwise using the Property, including any guests who are minors.
The Landlord declares and guarantees that it will process the personal data in its possession in accordance with the obligations assumed by contract, for the purposes and in the manner set out in the privacy policy attached hereto.
The Tenant undertakes not to allow the Property to be occupied by more than the number of persons indicated in the Booking Confirmation.
The Tenant may not sublet or lend, in whole or in part, the property, under penalty of termination of the contract.
The Tenant also undertakes to return the keys to the Property upon check-out.
The Tenant undertakes not to reproduce and/or deliver the keys of the Property Unit to third parties and/or to disclose any access codes to the same to third parties. The loss/breakage of the keys and/or the lock will result in compensation for the cost of a new lock.
PAYMENT:
The tenant must pay the total amount for the rental of the property, including tourist tax, 14 days before the day of arrival.
If the booking is made less than 14 days before arrival, the total payment is required in full at the time of booking.
Expenses related to the provision of services such as electricity, water, gas, and condominium fees are the responsibility of the tenant.
CANCELLATION POLICY:
Cancellation conditions vary according to the rate booked:
Standard: free cancellation up to 14 days before arrival
Non-refundable: In case of cancellation, modification, or no-show, the total amount of the booking will be charged.
Super Flex: you can cancel free of charge up to 5 days before arrival
Weekly: you can cancel free of charge up to 7 days before arrival
Monthly: you can cancel free of charge up to 14 days before arrival
PROPERTY CONDITION:
At the end of the rental period, in the event that any non-compliance or damage and/or theft of goods, equipment, furnishings or damage to the Property is found, the Tenant must notify the Landlord of this circumstance by sending, by 6:00 p.m. on the day following check-out, an email to the Tenant's email address containing a detailed description of the findings, supported, where possible, by appropriate photographic documentation.
In any case, the Tenant hereby expressly authorizes the Landlord to charge the amount of the damage found to the credit card indicated at the time of booking and/or to the credit card provided as a guarantee and/or to any cash deposit, based on the specifications in Annex A within 48 hours of check-out.
CHECK-IN and CHECK-OUT:
Check-in is from 3:00 PM onwards. Any early arrivals must be requested from the staff and approved before entering the apartment.
The keys are located inside the Masterlock key box. Please keep them safe and take care of them. At check-out, they must be returned to the Masterlock, changing the combination on the keypad.
If the keys are lost, we will charge the cost of making a copy, starting from 200 CHF (see ANNEX A).
The apartments must be vacated by 10:00 a.m. on the departure date, unless otherwise agreed with the staff at check-in (late check-out). After 10:15 a.m., we will ask you to leave the apartment immediately or we will charge an extra fee of 50 CHF.
After 12:00 p.m., the total amount for an additional night will be charged.
FINAL PROVISIONS:
Swiss law applies to the tourist rental agreement. The place of jurisdiction for any disputes arising from the interpretation, execution, and anything else related to this tourist rental agreement is Lugano.
